Class Action Filed Against Drilling Company For Toxic Dumping

A class action lawsuit has been filed on behalf of 5,000 residents of Battlement Mesa, Colorado against Antero Resources in Denver District Court, alleging that soils dumped in the Eagle County Landfill from natural gas explorations and production threaten the health and well-being of the residents. Antero began dumping soils in the landfill in 2010.

This is the second lawsuit filed against Antero, the first alleged that contaminants and fumes drove a Silt Mesa family from their home.

The Eagle County communications director, Kris Friel, said that the soils “go through a number of tests before acceptance…We have not accepted, nor have we been asked to consider accepting, other kinds of (exploration and production) waste such as used pit liners.” Fracking ponds, that hold a mixture of water and chemicals used in hydraulic fracturing, are lined with pit liners.

The class action lawsuit seeks to force Antero to establish a medical monitoring fund for research and treatment of any illness connected to drilling activities, and for Antero to use state-of-the-art safety measures to protect the health of residents. The lawsuit also asks for compensation for homeowners who have lost property value because of the drilling rigs, the Vail Daily has reported.
