Civil Lawsuit Brought Against Roman Catholic Diocese of Albany

A civil lawsuit has been filed in U.S. District Court in Burlington, against the Roman Catholic Diocese of Albany by the sexual abuse victim of former New York priest Gary Mercure. Mercure is currently serving a 20-year prison sentence after a criminal trial in Massachusetts found the priest guilty of raping the plaintiff in Massachusetts and New York during the 1980s.

According to the Associated Press, the lawsuit was filed in Vermont federal court because its statute of limitations in longer than in New York. The suit claims the sexual abuse took place in New York, Massachusetts, and Vermont.

Ken Goldfarb, a spokesperson for the diocese says, “This lawsuit is at an early stage and motions are pending. The claims against the Albany diocese have no factual or legal basis. We intend to vigorously contest them,” the Times Union reported.

During the criminal case, the victim said Mercure “was a manipulative man,” and that he was “a young boy….a shy kid.” The victim said Mercure raped him in the rectory of the Queensbury church, in the backseat of Mercure’s car on the way to Brodie Mountain during a ski trip, and as many as 10 other incidents, including at least that left him bloody.

The lawsuit seeks to expose the diocese handling of sexual abuse allegations made against priests.
