Casa Lopez Salmonella Lawsuit Gains Plaintiffs

Two lawsuits had been filed against Athens, Ohio restaurant Casa Lopez, one has been settled while the other adds more plaintiffs.

In two separate cases, Thomas Earl Ellis and Tyler Nay have both filed lawsuits against Athens, Ohio Casa Lopez Mexican restaurant for salmonella infections. Ellis’ lawsuit was dismissed with prejudice, while Nay’s suit is continuing to move forward in Athens County Common Pleas Court and has added additional plaintiffs, including Nay’s mother.

The Athens City/County Health Department has discovered that 56 people were infected with salmonella had eaten or been exposed to food from the restaurant from April 29 to May 5, 2011.

In response to the claims of the lawsuit, Casa Lopez claims, among other things,  that the salmonella infections were caused by the plaintiffs “sole or contributory or comparative negligence”, and that damages suffered “were caused by an intervening and/or superseding cause.”

The lawsuit does not specify a damage amount, but requests compensation “for all general, special, incidental, and consequential damages suffered by the plaintiffs as a result of the defendant’s conduct,” as well as attorney fees and costs.
