Canadian Court Approves Zimmer Hip Replacement Class Action Lawsuit

The British Columbia Supreme Court Justice Gregory Bowen  has approved a class action lawsuit against Zimmer GMBH that includes every Canadian who has had a Zimmer Durom Cup  hip replacement.

Susan Wilkinson is the class action representative, and says that she started to experience problems with her Durom Cup within three months of the implant surgery. Nearly one year after having the implant, she had to undergo revision surgery to have the Durom Cup removed.

The Vancouver sun has reported that 33 Durom Cup failures have been reported in Canada, though 4,900 of the devices have been sold in Canada. The class action lawsuit is expected to involved 100 people.

The Zimmer Durom Cup was recalled in the United States two years after it was introduced to the market, though a few months later it was available again with different warnings and physician instructions.

All lawsuits regarding the hip replacement device filed in the US have been consolidated in MDL in the US District Court for the District of New Jersey.
