Biomet Lawsuit Filed After Two Hip Implant Failures

The national law firm of Parker Waichman LLP has filed a lawsuit in U.S. District Court for the District of Nevada against Biomet Inc., Biomet LLC, and Biomet Orthopedics. The lawsuit was filed on behalf of a woman who had to undergo two risky revision surgeries because of the Biomet M2a Magnum Hip System.

According to the lawsuit, the plaintiff’s left hip was implanted with the Biomet M2a Magnum Hip System in December 2005. The metal-on-metal hip device failed, and she was forced to undergo a risky revision surgery to replace the hip with a new M2a Magnum Hip System.  This second M2a Magnum hip system also failed, and she was again forced to undergo a second revision surgery. Because of this, the lawsuit alleges that the plaintiff suffered economic damages, severe and possibly permanent injuries, pain and suffering and emotional distress.

The lawsuit further alleges that at the time of her first implant, the defendants knew of more than 100 adverse event reports regarding the M2a Magnum, yet the defendants hid this information from the plaintiff, her physician, and the public. Had the Defendants not made misleading statements about the safety and efficacy of the hip device, the plaintiff’s surgeon would not have used the M2a Magnum system, the lawsuit says.
