Another Lawsuit Filed Against Cargill Over Toxic Turkey

A Missouri couple, Susanne and Jerry Byerly, filed a lawsuit in the U.S. District Court in the Western District of Missouri, against Cargill Meat Solutions Corp after Mrs. Byerly was hospitalized for salmonella poisoning, allegedly from ground turkey produced at Cargill’s Springdale Arkansas plant.

The lawsuit claims that 111 people have gotten sick from tainted turkey, and at least one person has died from turkey products made by Cargill and infected with Salmonella Heidelberg.

The lawsuit says that Byerly became sick after her husband used the tainted turkey in spaghetti sauce on August 1. By August 11, Byerly was so sick she entered the hospital to be treated with intravenous antibiotics. After her discharge on August 12, Byerly learned that strain of salmonella that had infiltrated her blood stream matched the strain found in Cargill’s infected turkey.

According to the complaint, Cargill was aware that Salmonella Heidelberg had been detected in the Springdale Arkansas plant in 2010, and as far back as 2007, and that Cargill  “failed to alert consumers of the potential danger, issue a recall of products that it knew to be contaminated, or reasonably act to prevent consumers of its products from becoming infected and sickened by Salmonella Heidelberg.”
