A lawsuit has been filed against Takeda Pharmaceuticals in U.S. District Court for the Central District of California, over claims that the diabetes drug Actos causes bladder cancer.

In the first of what some attorneys are estimating to be thousands of lawsuits filed against Actos, California resident Jules Berck alleges that Takeda failed to warn of the risks of bladder cancer and that if he had been aware of the dangers connected to Actos, he would have used a different treatment.

Recent studies have shown an increased risk of bladder cancer for patients taking Actos, including one study that found that patients over 40 who used Actos for more than 12 months, had a 40% increased risk of bladder cancer. The FDA is currently reviewing the information and has not pulled the drug from the market. Actos sales were suspended in France and Germany in June 2011 over the bladder cancer connection.

The lawsuit alleges that Takeda knew or should have known about the increased risks of bladder cancer, and did not properly disclose those risks to consumers and their physicians.

The lawsuit is seeking monetary damages for Berck’s injuries.
