Accutane Lawsuits Scheduled For Autumn Trials

Judge Carol E. Higbee, who is overseeing the mass tort centralization of the nearly 3,500 lawsuits filed in New Jersey, has issued a court order preparing eight Accutane lawsuits for jury selection beginning October 11, 2011. Jury selection will begin in four other Accutane cases January 9, 2010.

Top selling Accutane, generic name isotretinoin, a synthetic vitamin formulation that is used to treat moderate to severe acne, earns manufacturer Hoffman La Roche an estimated $1.2 billion in annual sales.  Side effects of Accutane have been linked to serious gastrointestinal side effects, including inflammatory bowel disease, which can lead to painful conditions like ulcerative colitis and Crohn’s disease, and even cause damage to other internal organs.

Octobers trial will involved plaintiffs with similar circumstances with at least three of the plaintiffs having used Accutane after April 2002, while the January trial includes cases of plaintiffs who used Accutane before April 2002.

Millions of dollars in damages have been awarded in these early bellwether trials, where seven of nine juries have presented verdicts in favor of the plaintiffs.

At least 150 people have filed Accutane lawsuits in New Jersey in the past month, and the number is expected to continue to grow as previous Accutane users continue to be diagnosed with bowel related problems.
