7,000 Yaz Lawsuits To Remain MDL –Class Action Denied

Federal Judge David R. Herndon has denied class action lawsuit certification for the nearly 7,000 lawsuits filed against Yas and Yasmin manufactured by Bayer Healthcare.  The cases have been centralized and consolidated as part of Multidistrict Litigation (MDL) however, each plaintiff will be required to meet the burden of proof to move forward.

Judge Herndon says that the claims are too varied and are dependent on too many variables and individual circumstances to warrant certifying them all in one class action lawsuit.

The lawsuits allege that the women who took Yaz, Yasmin and similar birth control medications suffered heath problems including

•    Heart Attack or Stroke
•    Blood Clots
•    Deep Vein Thrombosis (DVT)
•    Pulmonary Embolism (PE)
•    Gallbladder Disease
•    Sudden Death

The lawsuits also claim that Bayer failed to provide adequate warning regarding the severe and possibly life threatening side effects of Yaz.

A woman in Louisiana who claims to have suffered a deep vein thrombosis from Yaz requested the class action. Bayer moved against have the lawsuits formed into a class action because of the individual nature of the circumstances in each lawsuit.
